A deed of surrender for ending a residential tenancy by mutual agreement. As a deed (rather than a simple agreement), it offers the strongest legal certainty that the tenancy is fully terminated.

What this document is

A deed of surrender is a formal legal instrument signed by both landlord and tenant, witnessed, that records the end of the tenancy. Because it is a deed, it has stronger legal effect than an exchange of letters or a simple surrender agreement.

When to use a deed instead of an agreement

  • Long-term or high-value tenancies where future disputes would be expensive.
  • Tenancies that include unusual provisions (rent guarantees, options to renew).
  • Where one party wants belt-and-braces certainty that the tenancy is fully extinguished.

Execution requirements

For the deed to be valid, both parties must sign in the presence of an independent witness. The witness signs and prints their name and address. Keep the original signed deed safely — loss of the document does not invalidate the surrender, but proof of surrender becomes harder.
